We bought a new washing machine from Sears. They installed in on September 11, 2015.

The delivery person failed to fasten the hot water tubing tightly. It flooded the kitchen an adjacent bedroom. This caused a documented $4,000.00 damage. Sears gave us a claim number.

However, they then said that "XPO Logistics," the company Sears hired to deliver and install the washing machine, would be responsible for the damage. Then today, October 2, 2015, Sears said the insurance for the truck driver of XPO Logistics would be responsible. We paid Sears to deliver and install the washing machine: not XPO Logistics, and certainly not XPO Logistic's truck driver. We had to live with the loud sound of professional dryers to mitigate the damage of the flood.

Does not Respondeat Superior apply here? We paid Sears.

Sears contracted with (xyz). (XYZ) damaged us, but Sears is the agent with whom we dealt.

This reviewer shared experience about "you flooded our house" and wants this business to "pay for the mitigation of damages we paid out of pocket, plus the closet work we are having to replace, plus damages for lacking a closet for 3 weeks" as the author lost $4000. ArchBlake-123 is overall dissatisfied with Sears. The most disappointing about xpo last mile delivery at Sears was any thing about hte last purchase, blowing us off for 3 weeks and negligence Reviewer wants customer support to reach our to him or her ASAP for further discussion of this matter.
